Was it the fact that a uniformed state trooper noticed his apparent crouched over ,sleeping . the officer not knowing his condition obviously checked on his well being . The evidence suggest that the defendent bac of .08 is a serious concern for the well being of pedestrians and other drivers when the keys are in the ignition of the defendents vehicle. Obviously the trooper felt the mans well being was not ok as the defendent admitted to drinking two glasses of wine. The district attorney failed to acknowledge this dedicated troopers work and evidence gathered in making the decision to arrest this individual. Wasting state trooper man hours and sending the wrong message to this state trooper for future incidence of this type. Bottom line was that if the keys were in the ignition he was DWI. Didn't matter is the vehicle was moving or not. | ");

This drunk driver has a kill under his belt and has proven that he will continually drive while intoxicated and she throws out the case. If the police officer felt that there was enough evidence to arrest this killer, then how did Garcia not see the evidence? When are people going to wake up and realize that these drunk drivers are NOT going to stop when people who are in a postion to enforce the law, only dis-regard it.
